Exclamation Do i have a case against paypal?



I am curious if i have a case against paypal keep in mind i have all shipping info and messages saying that he got the replacement item.

I sold an item on ebay, buyer got the item and said it was messing up.

He sent me the item on the 29th of january and i sent a replacement the same day. Then he said the power for it didnt work so i said ok send that and ill replace that as well.

On ebay his exact words "i got the xbox yesterday but the power supply doesnt fit" then he said that its not his reponsibility to send me it when my item said no returns accepted anyway but when i have that stated they always make me fix it anyway.

so it started sounding sketchy so i sent it anyway with signature confirmation and he declined it when i got to him.

then 7 days later he made a claim with paypal saying he sent me the item and i never sent him anything back so i provided pictures and shipping info stating he got the item and they gave him his money back and im negative now and im not paying it when they are at fault because he shouldnt be under their protection.

i called them and talked to 3 different supervisors and a few other reps and proved to them that i am right and they all say they will fix it and set an appeal because they acknowledged that shouldnt have happened.

they say he has 3 days to respond and if he doesnt i get my money back every time on the third day they say they side with him cuz i replaced it outside of their process which is bull cuz i got it on the 29th and replaced it that same day so if im not in their "process" then neither is he.

he stated he got the item he shows no sign off communication and they said his account is 0.00 so he with drew it, and declined my second replacement.

This guy is a con and they are helping him when i provided more than enough proof, do i have a case to take this to court and sue because all the trouble and hassle and them making me go over my phone bill because they told me to call back on the third day after they appeals like 6 times.

Everybody has a case against paypal as long as it involves fraudulent transactions, deceit, and since the courts would favor a person who has good intentions rather than a multi-million dollar company that has bad rep.

Were you on that hype of selling SE'd Xbox ones?

Erm, you do have a case.. kinda. You have sufficient proof that the item was delivered so you should be able to win. Just keep calling them and escalate it to a supervisor.

I think you might have a case. I think what you need to ask yourself is, is the amount you might win worth going through legal proceedings. Sometimes just the threat of a lawsuit is enough to get PayPal to pay you back. Apply pressure to whoever you talk to at PayPal, explain the proof you have and tell them you want to avoid taking it to court. They will most likely settle.

Is this buyer supplying any proof of his claims? It's great that you're keeping a trail of proof of keeping up your end of the transactions and may help you. As for going to court with this against Paypal, I would think the case would be more against the buyer than Paypal even though Paypal is not helping and is largely at fault for all of this. Keep applying pressure to Paypal on this issue though and hopefully as other users have mentioned, they will just give you the money owed.

If you have proof then you definitely have a case. If you pressure them with legal action they'll probably resolve it before it comes to that. Keep contacting them and if they refuse to cooperate then tell them you'll sue.

Yes you have a case. Make sure you produce as much evidence as possible of what happened, otherwise PayPal is likely to swat you away.

My thoughts exactly. The cost of suing them might not be worth it. Definitely threaten them with legal action though as it should pressure them into taking action.

I'm new to this so sorry if I'm in the wrong spot. Please direct me to where I should be. :} I need to find out if I can/how I can get my money back from a sale to someone on Ebay where Pay Pal notified me the money had been received, yet it turned out the whole thing was fraudulent and I had been screwed out of my $850.00. I want Pay Pal to give me my money because their security is SO bad that criminals can just send me a fraudulent email "from" Pay Pal which causes me to lose everything! Please help!
