Default Need help...about to sue paypal!!





A ebay member (calcmn732) bought $1100 tires off me. I shipped them. He received them. Never responded to any emails. One month later did a charge back. After research, it turns out he has done this 3 other times and one time after my inccident....so out of the few people he has bought from he did a chargeback 4-5 times.
Well, paypal said Visa went in the buyer's favor. So im out $1100.

Im new to this so any help would be greatly appreciated.
(i was not part of the 2002 lawsuit)

Did paypal take the money out of your paypal account or bank account? Are you looking to sue paypal or the person, calcmn732?

This happens all the time with paypal so the best way to protect yourself is to not use paypal anymore.

Did you have proof of shipping? Unless you have a tracking number you are screwed and I think if you ship something that is over $250 you will have to have insurance and signature required or paypal will not help you in any way. But ever in cases when all this is present paypal sides with the scamming buyer. So basically you are damned if you do and damned if you don't. You can't win with paypal.

This is were law enforcement needs to be called.We are dealing with criminals every time this happens. One of these days someone is going to get hurt and law enforcement will be needed. So to get past this and all problems associated with this criminal behavior we need a system that will work. To use preypal they need to set up a drop off point,and pick up point such as (GOIN POSTAL) or for that matter use all the revenue they generate through the fraudulent activity that occurs and open their own facilities for drop off and pickups. At these facilities they can take before and after photos of all products that are sold and shipped through ebay and preypal services. The shipping charges can be based on the price of the item sold as a flat rate. Myself I could careless because I will not be using either ebay or preypal again. But these two companies as large as they are should be looking for ways to prevent such activity. There has to be a solution. I can only hope that the government gets involved and they both go BANKRUPT and out of Business. These two companies think they are indispensable.

The wisest thing you can do now is report any Credit or Debit Card you ever gave PayPal as LOST. Close any Checking Account you ever gave PayPal immediately. Prevent PayPal from recovering money from you. PayPal participated in a fraud against you and you don't have to let them get away with it. PayPal will never go against the actions of a CC company, ever. If they did, eventually the CC companies won't allow you to use your CC at PayPal, just as they don't allow you to fund your online Poker account with a CC. Resign yourself that you will never again use PayPal. Tell any Collection Agency that you have never owed this money and that if they continue to attempt to collect a debt you are not liable for, you will sue them (this action makes them stop as they must prove you owe, which they can't do as they bought the debt for pennies on the dollar). Google Checkout is a good alternative. Opening a Merchant Account is another.

Your only chance is to take the buyer to small claims court. Take him to judge judy!
