Want to rip off any seller on eBay???

Just buy an item, claim it's counterfeit, "destroy" it, sign the affidavit, receive your refund & keep the item!

You don't need to submit any proof that from a manufacturer that it was counterfeit, nor any proof that it was destroyed by a qualified third party!


Sellers, has this happened to you?

I do not condone or suggest doing anything illegal, I'm just simply pointing out a flaw in the eBay user agreement and system.

This happened to me as a seller.

Has this happened to anyone else? What do you all think? It's so scarily easy to be ripped off because of this.

I was just ripped off over $500 because a buyer "claimed" the purchase was a fake and then "claimed" they destroyed it without ever having to prove evidence of the item being counterfeit or any proof of destruction from a manufacturer or official! This is total theft and the eBay & PayPal policies allow it to happen by NOT requiring buyers to provide proof.

how bout this 1... buy item, file claim(whatever, not as described, etc)... send it back(well, send back something, of equal weight, not the real item, of course...), have proof it was sent back, file for full refund... there is no way to prove the item, itself, wasn't sent back... we all know ebay and paypal side with the buyer 100%, not to mention, the person can't prove you didn't send back "the item"... pretty good eh? it'd be a shame if this secret got out...

There are tons of Youtube videos by sellers that this happened to. One guy had an antique radio stolen from him by a buyer who claimed it was not as described and got to keep the radio and get a refund.

Well the opposite for me. I got ripped off as a buyer and E-bay never replied back for the refund that I'm supposed to have.

I've seen a lot of people on this forum complain about having problems like this. It's absolutely ridiculous that this is allowed to happen.

I have heard that this happens, but I have also heard that is DOES NOT happen every single time like you imply.

eBay seriously needs to revise its policy on counterfeit items and how they are identified. The way it is right now is simply madness, all decision-making is left in the buyer's jurisdiction who stands to gain a full refund without having to provide evidence. The only thing I can think of to help protect sellers is taking pictures (maybe even video) of the item, and it being packaged and sent and go through small claims court against a buyer. But overall I think it's dangerous for sellers these days on eBay, especially ones looking to sell highly sought-after, high priced items.
