<bankdick>,

Someone should tell you people that you can't simply go down to your local court house and file a small claims dispute. You have to go to the city where the person/company resides. That means you have to go to the Bay Area and file your complaint. Not such an attractive proposition now is it.

Sorry, this is a little late, but this is not correct. In many (most?) jurisdictions, you CAN do just that. Most jurisdictions allow the small claims court case to be filed in their jurisidction IF the company or potential defendant is in their geographical area (like their state) OR if the potential plaintiff, the guy filing the claim, lives within their geographical area. I have looked into this and actually did sue Compaq in my own state even though their headquarters was in Texas.

They did exactly the same thing to me.
I quoted the user agreement saying they cannot get involved in 'not as described issues'.
I looked and you dont have to read very far to realise t it says the complete opposite. They say they will get involved with matters that are not "significantly" as described.
In my case the DVDs were fake and were not even burnt properly. They came from Hong Kong and I returned them.
For last two months I quoted the sections, which included one about taking action over genuine goods, and got the brain dead response that they cannot.
I believe they are deliberately trying to dissuade customers from making claims in this respect, because it is such a mine field for them.
But if I used by credit card, which I do through Paypal now, I get so much more protection.
I suggest everyone pays with the credit card. That way Paypal do not get any money to handle and you have much more protection.
The denouement is that as a last resort I wrote to the president of Paypal yesterday, explaining the farcical situation. The day I got a courtesy refund of the full amount.
I look forward to the written response.

Cheers

Help me to file a complaint against Paypal. I received merchanside not as described and therefore have returned back to seller. Seller claimed that he never receive the items and denied my refund. Then, I filed a Buyer Protection Claim with Paypal but here what they conclude
"Our investigation of this complaint is now complete.
As stated in our User Agreement, PayPal's Buyer Complaint Policy only applies to the shipment of goods, not to disputes about the attributes or quality of goods received. Therefore, we cannot reverse the transaction or issue a refund. If you still have concerns about this transaction, we encourage you to continue to work directly with the seller for an amicable resolution. PayPal does not tolerate fraud or illegal activities. Your complaint will be noted in the record of the PayPal user you reported"

My case now has been closed and I get nothing from them.

Hi,
Before engaging in what could very well be construed to be a harrassment campaign - check out the US Code Title 15 Chapter 41 Subchapter VI Sec. 1693-1693r (Electronic Funds Transfer Act). You should be contacting your financial institution and PayPal to dispute the transactions. You have 10 business days to do so.The financial institutions are supposed to respond within 10 business days as well PayPal , of course, is on its own time frame. I would strongly recommend you actually follow through with the PayPal Action Team's first 2 weeks of action. submit complaints to all legal agencies and the BBB. Skip the vendetta in week 3 and week 4. Gather together all paper documentation, and create your own paper trail by sending letters. Call or write the FTC - I've tried their online form and it is not working - don't forget to use their OMB #3084-0047 or they may ignore your letter. Don't forget to get in touch with your state's Attorney General, and check to see if PayPal is licensed in your state - and get in touch with that enforcing agency. It may take a while, but keep track of every contact. PayPal's address is 303 Bryant St, Mountain View CA 94041 (402) 935-2057. Their transaction dispute function does not work, but try it anyway

<Ron>,

Pretty basic in my opinion. Pro-rights people are using the same law and they have been allowed to post address' of doctors since they consider them killers. It was upheld in a court and I don't know which one. What I do know is that NPR reported the fact that their address' could be reported(over a year ago) and have not reported that the case has been overturned. Bottom line? I'm sure it's still law. You can post MANY things about employees online, and you can CERTAINLY post who has what extension and what group the report to. It's the same damn thing that the Yellow Pages do.

Quit the all the weed that's making you so paranoid. We have rights and we're not going to sit down and stop fighting paypal.

Stoney,
I don't think you understand my point. Elliot Spitzer says that it is illegal for a man in NYS to gamble in a perfectly legal casino in Antigua, Monaco or London via the internet wires. So he shut down the big New York bank whose name I cannot get to print here. You know who I mena the one headed up for so many years by Walter Wriston.

But Mr. Spitzer seems to have no trouble offering protection, legal protection, enforcement protection, lawsuit protection to the New York City Off Track Betting racket which accepts telephone bets from people in Florida contrary to Florida law. He is a hypocrite. HIS gambling don't stink, but everyone else's does?

Paying checks is what banks and money transmitters do. If you wire $10,000 by Western Union (Eastern Onion in case it censors out the name) to a kidnapper in West Virginia to let your daughter go or pay off your son's drug bill, that's for an clearly illegal purpose in every jurisdiction but the state of New York has no right to prevent Western Union sending the money and no right to impose on Western Union a duty to determine the legality, fairness and consumer benefit of every transaction.

You can charge alcohol at most any bar and you can charge cigarettes at the supermarket and givew them to a 12 year old. You can't put the banks in the job of law enforcement yet that's what they want to do with this "know your customer" nonsense.

If you want to carry around the 10 Commandments, you should realize that the government is the enemy of the Lord and that the Law of Karma is more sure than the Law of Gravity. Certainly more equitable than the law of Spitzer who supports socialized gambling (OTB, paramutuel and lottery) which is morally identical with "illegal gambling".

bankdick, The 200k was for the cost of the investigation. I don't know if they had to come up with anymore like ****, but they had to put 500k in a fund for charitable organizations like gamblers anon. We brought the illegal gaming to his as well as other states AG. and when I talked to the deputy in charge of the case he said they are no looking it illegal prescription drugs sales through them. It's not the gambling I'm against it's the fact that PAYPONZI is deriving hundreds of millions from illegal sources and cheating the honest person. Our next issues are the hate groups and the pornography. Just remember

Paypal got slapped this week when Elliot Spitzer, NYS Attorney General, not only made them promise never to fund offshore (legal) gaming operations (as he similary got **** to proimise last month) but he forced PayPal to disgorge $200,000 in cash to him. If you dislike PayPal, you will enjoy this news.

I think Mr. Spitzer is a little heavy handed telling **** customers throughout the world, and PayPal customers, that we have to abide by the rules he has in New York State for citizens of that great state of taxation. New York State incidently, where they are happy to accept telephone bets from anywhere else in the world on their socialized, government-run Off Track Betting (OTB) racket.

Anyway, I am not so mad at PayPal anymore since they finally removed the freeze on my account, claiming it was put on due to eastern European attempts to sign on. I use ****.com instead, the one from First Natioanl City Bank of NY, whiohc I have a lot of trust and respect for since it is a real bank.

I am still mad at NetBank and am bashing them all I can at http://BankBranch.co.uk. Come over and help if you hate them too.

BankDick

RONC, While I agree with most of shut down paypal's site, it's like most others, it hasn't been tended to. Everyone (including myself) wants to put up a site. What that tends to do is divide people and that only helps Paypal. We need to come together in a common cause. Talking about it does no good. When we found that we lost our case I asked what we could do, one of my lawyers suggested if I could get a hundred thousand people
together, then we could bring Paypal to it's knees. Just today I read a site that was attempting to do something about internet pornography, (which paypal makes big bucks from). People joined together and they took 71,000
complaints to Washington. When you get Senators Delay and Dashle involved you've accomplished something.www.grassfire.net/mygrassfire.asp?rid= I suggest we set up one thread specificly for those who are serious about doing something, then go to the other boards and invite them to join. Together as a group we can grow and have the legal representation to get the job done. I ask the admin to set this up.
